Kilifi County deputy governor Gideon Saburi was found with a shock after the government brought his COVID-19 results in a Mombasa court.
Saburi who maintained that he has never tested COVID-19 positive still holds that the results in court were false and that kemri did not carry out any test on him.
His counsel George Kithi said that,Saburi had tested three samples at Coast general hospital but all were negative.
According to Kithi, his client was tested on 23March,26March, and 30March but all were negative.
The state has also filed another application seeking to detain Saburi for another 10 days to allow them completed investigation.
State counsel Alloys Kemo told the court that the reason why they want Saburi detained for another 10 days is to allow them to find out the reason why he traveled to Germany and if the trip was authorized by the Kilifi county government.
“we have not recorded the statement from the suspects driver who is still at isolation center after tested positive “said Kithi.
Saburi has contested the application and want the court to free him after spending about two weeks at port police station in Mombasa.
Mombasa senior resident magistrate Rita Omwayi will on Thursday rule wither the suspect will be released on bail or detained for another 10 days.
Court heard that on diverse dates between 6th March 2020 and 22rd march 2020 within Kilifi County in the republic of Kenya while suffering from an infectious disease namely COVID-19 willfully and without talking precaution exposed himself to the public.
Earlier the court dismissed an application by the DPP to remand the deputy governor at the port police for two weeks.
Omwayi said that the court could not determine that the suspect should be detained at the prison facility while he was not charged.
Saburi will also go for another test after his counsel presented documents showing that he never tested positive for the three tests carried on him.
