With The Law Society of Kenya (LSK) having threatened to petition both the National Assembly and The Senate to initiate a motion of impeachment against President Uhuru Kenyatta, many people including legal experts have said the move will be all in vain.
They argue that since president Uhuru has numbers in both the National Assembly and The Senate, the motion may not even be introduced in the house.
What if it is Introduced?
If LSK successfully manages to initiate the motion of the President’s removal, the move will be a great success to them. Below are the reasons why.
Because it is obvious that LSK will not manage to impeach the president, the introduction of a motion of impeachment on a sitting president in Kenya will go down the books of History.
To LSK, that alone will be enough success. The Council which voted unanimously according to its president, will have fulfilled their mandate.
Another reason why LSK will have succeeded in the introduction of the motion is that they will have communicated a message.
President Uhuru Kenyatta will, however little get the message that the Legal practioners want to bring ahead.
3.US Impeachment Scenario
Just like in the United States, when the House of Representatives approved articles of impeachment on charges of abuse of power and obstruction of Congress. Trump was acquitted by the Senate on these two counts of impeachment on February 5, 2020.
However, History was made, according to a study by FiveThirtyEight’s approval rating tracker, Trump’s disapproval rating stood at 54.8 percent on Wednesday morning, just 0.2 points below his 55 percent disapproval ranking on November 4 last year.
President Uhuru Kenyatta might not get impeached but his approval rating shall go down. To LSK, that will be a success since they accuse the president of failure disobedience of the law.
In summary, the opinion of the writer is that even if LSK will not impeach the president, initiating a motion towards his impeachment will be a success to them.
